1. Agency Relationship and Charter Arrangements
TC Jets desires to act as an authorized agent for the Client in arranging charter services between the Client and one or more certified air carriers (hereinafter referred to as "Carrier") under the applicable regulations of the United States Federal Aviation Administration ("FAA") and the Department of Transportation ("DOT"). By confirming a charter, the Client authorizes TC Jets to act as its agent to arrange the necessary charter services with the designated Carrier.
The flight(s) will be operated in full compliance with the United States Federal Aviation Regulations (FAR) Part 135. The Carrier will have operational control of the aircraft at all times, including decisions regarding the aircraft's flight, crew, and safety.
2. Flight Sourcing and Carrier Selection
TC Jets shall source flights through its Preferred Direct Air Carriers who meet all applicable FAA or Civil Aviation Authority (CAA) safety standards. In addition, these carriers are subject to further safety standards as established by TC Jets. TC Jets will only source flights from operators who meet its internal safety guidelines.
3. Acknowledgment of TC Jets’ Role
Client acknowledges and agrees that TC Jets is acting solely as an agent in arranging the charter flight(s) described in this Agreement. TC Jets is not responsible for the operation of the aircraft, the crew, or the flight itself. The Carrier retains operational control and responsibility for the aircraft and its operation at all times.
4. Binding Agreement
This Agreement shall remain in full force and effect for each charter flight arranged by TC Jets, and will be binding until canceled by either party in writing. This Agreement will be supplemented for each specific charter flight by a separate Charter Quote. The Charter Quote will outline specific details related to the flight, including pricing, cancellation terms, flight restrictions, aircraft description, and other pertinent information. Payment instructions will also be provided in the Charter Quote.
5. Liability Insurance
TC Jets, acting as an air charter broker, will maintain non-owned aircraft liability insurance in an amount not less than $5 million. This insurance will cover TC Jets’ role in arranging the flight but does not extend to the Carrier’s responsibilities or the operation of the aircraft.
6. Limitation of Liability
To the maximum extent permitted by law, TC Jets is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our Website or Services, including but not limited to:

Client agrees to indemnify, defend, and hold harmless TC Jets, its affiliates, officers, employees, agents, and licensors from and against any and all claims, losses, liabilities, damages, expenses, and costs (including reasonable attorneys' fees) arising from your violation of these Terms and Conditions or your use of our Website or Services.

Your use of our Website is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using our Website, you consent to our Privacy Policy.
9. Intellectual Property
All content on the Website, including but not limited to text, images, logos, graphics, and software, is the property of TC Jets or its licensors and is protected by copyright, trademark, and other intellectual property laws. TC Jets LLC Serves As An Agent For Air Charter Services On Behalf Of Our Clients. All Aircraft And Air Carriers Selected By TC Jets LLC Are Fully Certified By The Federal Aviation Administration And The U.S. Department Of Transportation Under Part 135 Regulations. Carriers Are Solely Responsible For The Air Transportation Arranged On Behalf Of TC Jets LLC Clients. TC Jets LLC Does Not Own Or Operate Any Aircraft. TC Jets LLC Is Not A Direct Or Indirect Air Carrier. All Flights Chartered Through TC Jets LLC Are Operated By Part 135 Air Carriers.
